Terms of use
Last updated 15 September 2026
These terms govern the use of Railspare, published by Emmanuel NICOLAS, Entreprise Individuelle (EI), 2 chemin du midi, 63960 Veyre-Monton, France (SIREN 752 754 192). Using the site means accepting them.
1. What Railspare is
Railspare is a matching platform. Rail operators post requests for quotation for rolling stock spare parts. Suppliers registered in the matching part category are alerted and may pay to obtain the request in full, so they can quote the operator directly.
Railspare is not a dealer. We do not sell parts, we are not a party to any sale that follows, and we take no commission on it. Once a supplier has the request, the commercial relationship is between them and the operator alone.
2. What Railspare does not do
These limits are deliberate, and it matters that they are read.
- We do not vet or certify suppliers. Registration checks that a company email address is used and that the company does not already hold an account. Nothing more. We make no check of qualifications, certifications, quality, solvency or ability to deliver. An operator receiving a quote is responsible for its own supplier selection and its own compliance obligations.
- We do not guarantee that a lead leads anywhere. A supplier who unlocks a request pays for the request and the contact details — not for a quote being accepted, an order being placed, or the operator replying at all.
- We do not check the accuracy of what is posted. Requests are read and classified by a person, but the technical content is the operator's.
- We do not act for either side. We do not negotiate, we do not arbitrate disputes, and we give no advice on price or specification.
- We do not take a commission on what a supplier sells. Once a supplier has unlocked a request, the commercial relationship with the operator is theirs alone.
- We do not sell a supplier's details to operators. An operator hears from a supplier only when that supplier chooses to contact them.
3. Rail operators
Posting a request is free, requires no account, and carries no commission of any kind. By posting, you accept that the request may be released, with your contact details, to any supplier who pays to unlock it — as described in our privacy policy.
You undertake to post genuine requests, to have the authority to post them on behalf of the organisation you name, and not to attach anything you are not entitled to share.
4. Suppliers
4.1 Account
Registration is free and requires a company email address. One account per company. You are responsible for keeping your password confidential and for everything done through your account.
4.2 Categories
Each account includes up to three part categories at no cost. Additional categories cost 40 €/month each, billed monthly in advance.
Cancelling an extra category takes effect at the end of the period already paid for: you keep the category, and the requests it brings, until that date, and it is not billed again. No refund or credit is issued for the remainder of a period already paid.
4.3 Paying for a lead
Each request carries a price, set by Railspare and shown before you commit. Declining a request costs nothing. Paying unlocks the operator's identity, contact details, specifications and any attached documents, and is a single payment — never a subscription. The request then stays available in your dashboard.
An unlocked request is not refundable. It is digital content delivered in full the moment payment is confirmed, and it cannot be returned. Because you are purchasing within your own professional field, the statutory right of withdrawal does not apply.
If a request turns out to be materially misdescribed or a duplicate, write to contact@railspare.com and we will look at it. We are not obliged to refund, but we would rather keep you than keep 45.00 €.
4.4 What you may not do
- Resell, republish or redistribute a request you have unlocked.
- Use an operator's contact details for anything other than quoting the request they posted — in particular, not for unrelated marketing.
- Open more than one account to obtain more free categories.
- Extract the platform's content by automated means.
We may suspend an account that does any of these, without refund of the current period.
5. Prices and payment
Prices are shown in euros and are final: the publisher trades under the French small-business VAT exemption, so no VAT is added and none appears on the receipt (TVA non applicable, article 293 B du CGI). Payments are processed by Stripe; we never receive or store card details. Invoices are issued by Stripe and available from the payment receipt.
If a subscription payment fails, Stripe retries over several days. Nothing is suspended on a first failure. If Stripe ultimately gives up, the subscription ends and the paid categories stop.
6. Availability
We aim to keep the service running but do not guarantee uninterrupted availability. Maintenance, a hosting failure or a third-party outage may interrupt it. A brief interruption does not entitle anyone to compensation.
7. Liability
Railspare is liable for its own service — the platform working as described here. It is not liable for the conduct, quality, solvency or delivery of any supplier or operator, nor for any loss arising from a transaction between them.
Where liability cannot be excluded, it is limited to the amounts you paid Railspare over the twelve months preceding the event.
Nothing here limits liability for fraud, or for anything that French law does not permit to be limited.
8. Ending the relationship
You may close your supplier account at any time by writing to us. Paid categories run to the end of the period already paid for. Requests you have unlocked remain yours; we keep the payment record for the period French accounting law requires.
9. Changes to these terms
We may change these terms. Suppliers with an active account will be told by email before a change that affects them takes effect. Continuing to use the service after that means accepting the new terms.
10. Governing law
These terms are governed by French law. Both parties act as professionals. In the absence of an amicable settlement, the competent courts are those of the publisher's registered address.
